What is an Accident Replacement Vehicle?

An Accident Replacement Vehicle, is a vehicle provided to you on a credit hire basis. A replacement vehicle can be supplied to not at fault drivers at no cost, meaning you have an immediate vehicle whilst yours is being repaired or until your claim has been settled.

Who pays for the Accident Replacement Vehicle?

If you are the not-at-fault party involved in the accident you will not be required to pay for the hire costs. Keep Driving  take on the responsibility of recovering
these costs from the at fault party.

We guarantee, that if you provide us with the necessary and truthful information and adhere to the terms and conditions set out in the agreement, there will be no 
charge.

What rights do not at fault drivers have?

Your rights following a not at fault accident are covered under Australian Tort Law. If you are the not at fault party involved in a motor vehicle accident, you have a right to claim for an accident replacement vehicle. Claiming a replacement hire vehicle through Keep Driving allows you to get back on the road for with no out of pocket cost*. We will take on the responsibility of recovering the cost from the at fault party.

What information do you need to apply for an Accident Replacement Vehicle?

To be able to recover the costs from the at fault party we require the following information:
• Your details, including driver’s licence number, car registration and insurance information
• The at-fault party’s details, including their driver’s licence number, car registration and insurance information
• Details about the car accident.

What obligations do you have?

It is important to read our terms and conditions set out in your agreement, before signing it. Those terms include:
• Act in the best interest of Keep Driving
• Not hold up the recovery of the rental costs from the at-fault party
• Provide all documents reasonably required
• Be open and frank with us and not mislead us in any way
• Not release or allege to release the at-fault party from any of your rights in respect to the accident
• Provide us with assistance in the recovery process which may include providing copies of vehicle registrations and other supporting documentation
• Advise us promptly when your car repairs are complete or if you are notified of a total loss settlement

Will I need to pay for anything?

No, you will only have to pay the cost of fuelling the replacement car. Your replacement car costs are put on credit. At the end of the hire period, Keep Driving will recover theses costs from the at fault party.

It is, important to note you will be responsible for any fines or parking infringements relating to traffic offences and parking while the loan vehicle is in your possession.

You may be required to pay for additional cleaning costs and/or unacceptable wear & tear, if the car was returned contrary to the delivered condition. Other additional charges may include the fuel costs if the tank was not returned at the same level and/or administrative costs.

Business Customers
If the vehicle involved in the accident was registered for business purposes, then the owner is required to pay the GST component of the hire cost at the end of the hire period. The owner is entitled to claim back the GST on their BAS.

Do I need to provide a credit card?

Yes, we require your credit card details at the time of hire. Your card details are taken as a security measure for any costs incurred whilst using our replacement vehicle. These costs are listed in your Rental Agreement which include:

  • Fuel (if you return the vehicle and it requires fuel)
  • Traffic or parking infringements,
  • Vehicle cleaning (if returned dirty)
  • Unacceptable wear & tear
  • Excess or damage
  • Administrative costs

What to do if you're in an accident and it's not your fault.

Are there any restrictions to book a car with Keep Driving?

Drivers are required to hold a full and current driver’s license. Keep Driving also require the at-fault-party’s details to be able to provide you with a no cost vehicle.

Do you provide Accident Repair Rental Cars in regional areas?

Yes, we provide our service to all people across Western Australia.

The insurance company has requested I sign a title of deed, is this OK?

Sometimes an insurer may ask you to sign a document releasing the insurer from any further liability. This is so you agree not to pursue any claims for further loss, including the cost of hiring our vehicle. The document is often called a Deed of release or a Release agreement. We ask that you do not sign any document presented to you by the ‘at fault’ party or their insurer for signature, without contacting us first.

If you fail to do so and we are then unable to recover the hire car costs, you may have to pay us the hire car costs out of your own pocket.
